仲裁機構組織與調解程序及費用規則第35條疑義釋示Interpretation of Article 35 of the Rules on Arbitration Institution, Mediation Procedures and Fees


本會為促進仲裁程序效率,達到集中審理目的,爰參酌國際仲裁實務運作,積極推廣仲裁案件使用「案件管理會議」機制。因涉及仲裁機構組織與調解程序及費用規則(下稱「費用規則」)第35條中所稱「仲裁詢問」之定義,以及詢問會是否包括以電話會議、視訊等非實體會議方式舉行之案件管理會議,乃於日前函請主管機關法務部釋示。
In order to increase the efficiency of arbitration procedures through centralized hearings, CAA has been promoting the use of Case Management Conference (CMC) in arbitration. However, such mechanism may raise problems under Article 35 of the Rules on Arbitration Institution, Mediation Procedures and Fees, specifically whether the ambitious definition of “arbitration inquiry” includes CMC, and whether such CMC can be conducted by telephone, video-conference or other means of communication. CAA therefore sought interpretative clarification from the relevant authority of the Ministry of Justice.

法務部援引其於102年就同條第2項「仲裁詢問開始」函釋內容表示,就實體法律關係有所商議始謂開啟仲裁詢問。因此,若於案件管理會議中,仲裁人與當事人間所討論之事項涉及實體事項,即得謂之為「仲裁詢問」。另,基於當事人自治原則,且現今通訊科技發達,倘經合意,案件管理會議非以實體會議之方式進行並無不可。
The Ministry of Justice responded by citing its previous interpretation made in 2013 concerning Article 35(2) of the Rules – namely, the phrase “the arbitration inquiry has started” means that the arbitral tribunal and parties have started discussing the substantive matters of the arbitration. Likewise, if the discussions during a CMC relate to substantial matters, then such CMC would fall within the definition of “arbitration inquiry”. Additionally, because of party autonomy and technological advancement, CMC need not be held in person if the parties so agree.
