仲裁約定問題盤點與新趨勢
 
「2023臺灣仲裁週」之系列活動「仲裁約定問題盤點與新趨勢」研討會,於10月25日下午由常在國際法律事務所與常在法律文教基金會共同於南山微風廣場11樓常在國際法律事務所會議室舉辦。本場活動特邀請宏碁集團全球法務長吳麗娟、中鼎工程股份有限公司法務長劉英芳、輝瑞大藥廠股份有限公司法務長關國然、元太科技工業股份有限公司法務處長蘇瑛珣與常在國際法律事務所資深合夥人朱麗容律師、合夥人王仁君律師、合夥人王韋傑律師、合夥人林哲誠律師及合夥人林麗琦律師共同就以下列舉問題與趨勢,自公司法務或外部律師視角,提供與會法界同道應如何思考與分析。本會吳永乾理事長全程參與,表示感謝各界支持,並發表與會感言。

Reflections on Arbitration Agreements and Emerging Trends
 
On October 25, 2023, Tsar & Tsai Law Firm, in collaboration with its legal foundation, hosted a seminar titled "Reflections on Arbitration Agreement Issues and Emerging Trends." This event, graced by leading legal professionals, took place in the afternoon and served as a platform for insightful discussions on arbitration agreements.
 
The seminar featured a distinguished panel of speakers, which include Ms. Lydia Wu, General Counsel at ACER's Global Legal division; Mr. Yin-Fang Liu, General Counsel at CTCI; Mr. Guo-Ran Guan, General Counsel at Pfizer; Ms. Yin-Xun Su from E Ink Holdings Inc, Ms. Lillian Chu, Ms. Jeanne Wang, Mr. Vincent Wang, Mr. Vincent Lin and Ms, Lynn Lin, Partners from Tsar & Tsai Law Firm . Each contributed valuable perspectives based on their extensive experience in the field.
 
Dr. Joe Y. C. Wu, Chairman of the CAA, also participated and expressed gratitude for the support and engagement at the event. The seminar delved into several key topics, which are crucial for understanding the current and future landscape of arbitration agreements. These topics included:
 
 • Key Considerations in Dispute Resolution Clauses: Examining what factors are most critical when drafting these clauses.
 • Challenges of Multi-Clause and Pre-Arbitration Procedures: Discussing the potential problems and risks associated with complex dispute resolution frameworks.
 • Arbitration-Mediation Hybrids: Exploring opinions on the development of processes that combine arbitration with mediation for more effective dispute resolution.
 • Selecting the Arbitral Seat: Analyzing how factors like convenience, cost, technology, and information security influence the choice of the arbitral seat.
 • Choosing an Arbitral Institution: Considering aspects such as professional expertise, arbitrator selection, predictability of proceedings, and transparency in the decision-making process.
 • Efficacy of Standard Arbitral Clauses: Debating whether the standard clauses provided by arbitral institutions sufficiently meet all necessary requirements.

The seminar provided an enriching experience, and contributed  significantly to the ongoing dialogue about the evolution and best practices in arbitration agreements.

不動產爭議解決與區塊鏈之連結

10月25日下午舉辦「不動產爭議解決與區塊鏈之連結」研討會,由本會與中華不動產仲裁協會在本會共同主辦。首先由本會李永然常務理事代表協會致歡迎詞,李常理表示:現行法院訴訟案件劇增,希望透過訴訟外紛爭解決機制的運用來疏解訟源,尤其是透過專業的仲裁人士組成仲裁庭來審理,將更具可信度。將區塊鏈應用在仲裁制度上,是很棒的構想。

本次研討會分為二場議題進行,第一場為「區塊鏈與不動產租賃仲裁」,邀請逢甲大學土地管理學系陳建元教授主講,講題為「仲裁機制與區塊鏈技術結合之應用優勢」。陳教授從租賃服務業的角度切入,指出當前不動產市場問題、為解決不動產糾紛爭議及透過小額訴訟與簡易仲裁的比較,指出各別優缺點,建議選擇用仲裁來解決是更適合的機制;若仲裁加上新的科技工具即區塊鏈的運用,將可更快速、專業、彈性與因地制宜的解決紛爭。

第二場議題為「區塊鏈與不動產交易仲裁」,邀請雪喬股份有限公司周頌鈞執行長主講,講題為「國家級區塊鏈發展現況與資料保存機制」,周執行長先從技術層面介紹區塊鏈的概念及運用方式,進一步比較公有鏈、私有鏈及聯盟鏈的優缺點以及目前已有的壽險業運用與資料保存、驗證狀況。

Exploring Blockchain in Real Estate Arbitration

On October 25, 2023, a groundbreaking seminar, "Application of Blockchain Technologies in Real Estate Dispute Resolution," was co-hosted by the Chinese Arbitration Association (CAA) and the Chinese Real Estate Arbitration Association (CREAA). This afternoon event marked a significant step in integrating modern technology into arbitration practices.

Yong-Ran Li, the Executive Director of CAA, inaugurated the seminar with insightful opening remarks. He underscored the expertise of the arbitral tribunal, comprising industry veterans, which ensures the reliability of their decisions, often surpassing that of traditional court rulings. Li's emphasis on the potential of blockchain technology in revolutionizing arbitration mechanisms set the tone for the seminar.

The event unfolded in two distinct sessions:

 • "Blockchain and Real Estate Lease Arbitration": Prof. Chien-Yuan Chen from Feng Chia University's Department of Land Management led this session. Prof. Chen provided an in-depth look at how blockchain technologies could be seamlessly integrated into arbitration processes, particularly in real estate leasing disputes. He outlined the current challenges in the real estate market and proposed blockchain as a solution to enhance arbitration efficiency, professionalism, and flexibility.

 • "Blockchain and Real Estate Transaction Arbitration": The second session featured Eric Chou, CEO of Snowbridge Inc., who delved into the latest developments in blockchain technology. Chou presented a nuanced comparison of the various types of blockchains, such as public, private, and consortium, and their respective advantages and drawbacks. Using the life insurance industry as a case study, he demonstrated how blockchain can be employed to securely preserve and verify data.

This seminar marked a pivotal moment in the intersection of technology and legal processes, highlighting the transformative potential of blockchain in real estate dispute resolution.
