法務部研商「仲裁法修正草案」進度Update on the Ministry of Justice's Efforts to Revise the Arbitration Law


法務部為辦理該法研修事務,研析模範法與德、星、瑞士、日本、奧地利等國立法例及相關國際仲裁規則、參酌本會及立法委員提出之仲裁法修正草案、徵詢政府機關意見、蒐集有關仲裁法文獻、以及檢視歷年相關行政函釋、判決,於112年2月14日就其擬具之仲裁法修正草案初稿召開座談會外,並特就仲裁法修正較具爭議疑義如:增訂投資仲裁、仲裁庭之臨時保全措施及緊急處置章節,於5月24日、30日與7月3日進行意見溝通。同年11月13日起至113年1月24日止,法務部就其所擬之仲裁法修正草案修正版已召開6次逐條研商會議,目前討論至仲裁庭組成章節,期間並有出席教授舉本會對於仲裁人應與告知事項可供參考,建議法務部可請本會協助提出修正建議條文。

本會吳永乾理事長偕李復甸前理事長、李念祖名譽理事長、協合國際法律事務所吳必然資深顧問、政大許耀明教授、環宇法律事務所孔繁琦主持律師、理律法律事務所初級合夥人李劍非律師、陳緯人律師就可能討論之議題或條文分別出席修法會議,積極提出建言,希望該次修法能符合國際仲裁潮流,落實參採聯合國國際貿易法委員會國際商事仲裁模範法條文精神。

On February 14, 2023, the Ministry of Justice (MOJ) convened a forum to deliberate on the proposed revisions to the Arbitration Law. Prior to this forum, the MOJ conducted comprehensive research into the arbitration laws of Germany, Singapore, Switzerland, and Austria. This research also included an examination of international arbitration regulations, the draft amendments proposed by the Chinese Arbitration Association (CAA), arbitration guidelines, and relevant judicial decisions. After the forum, specific contentious issues such as investment arbitration and the arbitral tribunal's power to issue provisional measures were thoroughly examined in separate sessions.

Between November 2023 and January 2024, the MOJ organized a series of six detailed discussions, which focused on a thorough, article-by-article examination of the draft amendments. The discussions have now turned to a critical chapter concerning the "Constitution of Arbitral Tribunal." The academics that attended the forum have recommended that the MOJ consult with the CAA to define and list potential conflicts of interest that arbitrators are required to disclose.

Figures in the field such as CAA Chairman Wu, CAA Honorary Chairman Ful-Dien Li, Nigel Li, Dr. Pijan Wu from LCS & Partners, Prof. Yao-Ming Hsu from National Cheng-Chi University, Frank Kung from Liang & Partners Law Offices, Jeffrey Li from Lee and Li, and Joyce Chen from Lee and Li have actively participated in these discussions. Their contributions are aimed at guiding the MOJ towards adopting an arbitration law that not only meets international standards but also embraces the core of the UNCITRAL Model Law. Their collective expertise is anticipated to play a significant role in shaping a law that is conducive to modern arbitration practices.
