本會與廈門律師協會及廈門仲裁委員會簽署交流備忘錄Tri-Party MOU Expands CAA Reach in China


為具體落實本會與廈門仲裁委員會於110年11月3日簽訂之合作備忘錄,本年9月7日兩會與廈門律師協會簽署三方夥伴業務交流備忘錄,擴大提供海峽兩岸企業於台灣、大陸及其他第三地解決商務爭端的調解、仲裁和相關法律服務。
To effectively implement the cooperation memorandum signed between the CAA and the Xiamen Arbitration Commission on November 3, the CAA, together with the Xiamen Lawyers Association and the Xiamen Arbitration Commission, signed a new memorandum on September 7 of this year. The objective of this memorandum is to expand our mediation, arbitration and related legal services for businesses across the Taiwan Strait, in Taiwan, China and other third-party locations, to facilitate the resolution of commercial disputes.

廈門律師協會王桂英會長指出,仲裁業務是律師業務重中之中,律師不僅能擔任仲裁人,更多的機會是擔任仲裁代理人;廈門市的台籍律師人數約30多位,居大陸各省之冠。廈門仲裁委員會張玉生秘書長進一步指出,該會是大陸最早聘任台籍仲裁員的仲裁機構之一,自 112年12月5日揭牌設立涉台仲裁中心時起,已受理涉台仲裁案件約250多件,仲裁標的金額近8億人民幣,聘任的65名仲裁員中,台籍仲裁員就有26名。
President Gui-ying Wang of the Xiamen Lawyers Association pointed out that arbitration is a crucial area of legal practice, where lawyers not only serve as arbitrators but often have more opportunities to act as agents. There are about 30 Taiwanese lawyers in Xiamen, the largest amount among all provinces in China. Secretary-General Yu-sheng Zhang of the Xiamen Arbitration Commission further noted that their commission is one of the earliest arbitration institutions in China which appointed Taiwanese arbitrators. Since the establishment of the Taiwan-related Arbitration Center on December 5, 2023, approximately 250 Taiwan-related arbitration cases have been handled, with the amount in dispute nearing 800 million RMB. Among the 65 appointed arbitrators for the cases, 26 of them are Taiwanese.

本會吳永乾理事長認為,本會所受理的涉兩岸仲裁案件,尚未有約定仲裁地為廈門或其他大陸城市的主要原因,應該是本會無法就近向台商提供服務,台商也不知道在大陸經商所發生的爭議可以約定由本會在大陸城市處理。這次承蒙廈門市司法局的支持,與廈門律師協會、廈門仲裁委員會的協助,使本會在海絲中央法務專區能有一個可曝光及使用的聯絡場域,讓台商在紛爭解決機構上能有更多的選擇。吳理事長特別央請在場觀禮的台商協會代表轉告其他台商,本會將在此落點,未來可以有效提供商務仲裁與調解服務。
CAA Chairman Joe Y. C. Wu believes that the primary reason arbitration cases involving both sides of the Taiwan Strait have not designated Xiamen or other mainland cities as the arbitration seat is due to the lack of nearby services provided by the CAA. Additionally, many Taiwanese business people are unaware that disputes arising in China can be agreed upon for arbitration by the CAA in mainland cities. With the support of the Xiamen Municipal Bureau of Justice and the assistance of the Xiamen Lawyers Association and the Xiamen Arbitration Commission, the CAA now has an accessible contact point within the Maritime Silk Road Central Legal Service Zone. This provides Taiwanese business people with more options for dispute resolution, which is both meaningful and beneficial for business operations. Chairman Wu specifically urged the representatives of the Taiwanese Business Association in attendance to inform other Taiwanese business people that the CAA will be able to effectively offer commercial arbitration and mediation services moving forward.
