拜會台灣自來水股份有限公司
 

本會吳永乾理事長於6月14日上午由李天任秘書長、台中辦事處陳建國主任陪同，拜會台灣自來水股份有限公司(下簡稱台水公司)，獲李丁來(工程)副總經理及法制處吳奇政組長、工程處王振南組長兩位主管熱忱接待，雙方就台水公司各單位近年來工程採購與承攬廠商糾紛案的爭議處理方式及工程合約內容約定仲裁條款，廣泛交換意見。

吳理事長表示，台水公司為經濟部所屬事業機構，中台灣地區規模最大的國營事業單位，歷年來相關工程項目採購標案件眾多，本會統計就台水公司各單位之採購糾紛成立仲裁案件統計(92年至102年)共計有8件，惟近十年來相對較無提交仲裁案件，期待台水公司繼續支持政府司法改革國是會議推行的ADR政策，建議承辦單位加強政府採購法規講習及相關工程合約納入以仲裁解決爭議之條款。

吳理事長指出，本會是國內歷史最悠久、最具規模及公信力的仲裁機構，於北、中、南部均設有專業場所及案件管理人才，因此各行業交易合約約定仲裁機構，均以本會為首選，並提出本會與其他仲裁機構之品質及服務比較。台水公司現有採用公共工程委員會擬定的定型化契約範本，其第22條有關爭議處理提交仲裁的規定，建議明確約定：契約雙方同意將爭議提付中華民國仲裁協會依仲裁程序解決之。

經雙方充分交流意見，台水公司李丁來副總經理表示歡迎本會來訪，將本次交流建議呈報後交辦相關單位研議，並期待與本會持續會務交流及未來合作規畫安排各種採購法制訓練課程。

Visiting TWC
 

Dr. Joe Y. C. Wu, Chairman of the Chinese Arbitration Association (CAA), together with Secretary-General Dr. Tien-Rein Lee and Director Chien-Kuo Chen from the CAA Taichung Office, paid a visit to Taiwan Water Corporation (TWC) on the morning of June 14^th, 2023. The CAA delegation received warm welcome from Vice President Dr. Tin-Lai Lee of TWC and two other Directors, Mr. Qi-Zheng Wu and Mr. Zheng-Nan Wang. The meeting primarily focused on discussions related to recent construction projects and procurement disputes at TWC, as well as the inclusion of arbitration clauses in contracts.

As one of the largest state-owned enterprises, TWC handles a great number of procurement projects each year. Between 2003 and 2013, eight arbitration cases involving TWC as a party were submitted to the CAA. However, the number of cases has declined since then. Chairman Wu expressed his hope for TWC to recognize the benefits of alternative dispute resolution (ADR) mechanisms and suggested that TWC hold more lectures on government procurement regulations and incorporate an arbitration clause into related construction contracts.

As the largest and most experienced arbitral institution in Taiwan, the CAA possesses abundant resources and offers comprehensive case management services. It also has professional venues in north, central and south regions of Taiwan. Therefore, in the agreement, the CAA is prioritized as the first choice to be appointed as the arbitral institution for transactions in diverse industries. It is suggested that, Art. 22 of the current standard contracts provided by Public Construction Commission should expressly stipulate the following: both parties agree that any disputes shall be settled by arbitration referred to the CAA.

Vice President Lee assured Chairman Wu that TWC would start to deliberate internally regarding the adoption of arbitration and expressed their willingness to continue collaborating with the CAA to explore further opportunities for cooperation.

拜會臺中律師公會暨臺中律師學院
 

本會吳永乾理事長於6月14日中午由李天任秘書長、台中辦事處陳建國主任陪同，邀請本會中部地區監事、顧問及臺中律師公會代表進行餐敘交流。臺中律師公會蘇若龍理事長、全律會監事何志揚律師(前彰化律師公會理事長)及本會吳梓生監事、謝文田顧問、郭林勇顧問、莊開旭顧問等應邀出席。

吳理事長一行於餐後接續拜會臺中律師公會並參觀公會新會所及臺中律師學院的律師教育訓練場地設備。吳理事長盛讚臺中律師公會成立全國首創的「臺中律師學院」，該院乃執業律師在職訓練課程的專業組織及優質場所，本會期盼能與全國及各地律師公會持續合作開辦仲裁課程及法律講座，以推廣訴訟外紛爭解決機制。

行程後段吳理事長與臺中律師學院蘇若龍院長共同主持合作交流會議，本會李天任秘書長、郭林勇顧問、莊開旭顧問、陳建國主任與律師學院主要幹部吳中和副理事長、何俊龍執行長、王志文理事等人均參與討論，並就兩會未來舉辦仲裁推廣與培訓活動達成合作方案如下: 1. 由本會協助安排仲裁人訓練及專業講習課程，積極協助中部地區律師快速認識仲裁制度並登錄成為本會仲裁人；2. 本會規劃與臺中律師公會合辦一場「2023臺灣仲裁週」主題研討會，期使臺灣仲裁週成為國內法界交流的年度盛事；3. 臺中律師學院將於現有律師在職訓練課程中開設「ADR (仲裁)」專業課程，並與本會規劃一系列帶狀課程。

經兩會充分交流及討論，蘇若龍理事長表示歡迎本會率團來訪，肯定本會長年提供臺灣最優質的仲裁人訓練及案件服務，且與本會歷年合辦的各項律師專業課程均廣受好評，未來將持續與本會合作交流。

Visit TCBA and Taichung Academy of Attorneys 
 

In the afternoon of the same day, Chairman Wu visited with Mr. Jo-Lung Su, Chairman of the Taichung Bar Association (TCBA). Chairman Su introduced the newly established Taichung Academy of Attorneys, whose aims to provide continuing education training for practitioners. Recognizing their mutual interest in promoting arbitration, Chairman Wu expressed his enthusiasm for collaborating with all other bar associations to develop arbitration training courses, thereby promoting alternative dispute resolution (ADR).
 

During the meeting, co-chaired by Chairman Wu and Chairman Su, both CAA and TCBA engaged in extensive discussions on future collaborations and communication. The CAA committed to providing customized courses, assisting attorneys from central area with the necessary skills and knowledge in arbitration practices, and enabling them to qualify for registration on the CAA panel of arbitrators. In return, Taichung Academy of Attorneys agreed to offer a series of ADR courses for the current on-the-job training program. Additionally, TCBA will collaborate with the CAA to co-host a seminar during the 2023 Taiwan Arbitration Week, marking Taiwan Arbitration Week as an significant event in the domestic legal profession.

Chairman Su acknowledged the positive response from TCBA members regarding the courses offered by the CAA. In light of this, Chairman Su expressed gratitude to the CAA for consistently providing high-quality administrative services and training programs.
