從風險管理角度談臺商企業紛爭解決機制的選擇

本年度「2023臺灣仲裁週」的壓軸活動「從風險管理角度談臺商企業紛爭解決機制的選擇」研討會，於10月29日上午由本會臺中辦事處與臺中律師公會(臺中律師學院) 合作主辦、亞洲台灣商會聯合總會參與協辦。本場次活動目的在協助臺中律師公會及亞洲台灣商會會員們對仲裁有基本認識，並針對相關法律資源進行介紹。研討會邀請中華經濟研究院東南亞國家協會研究中心徐遵慈主任、吳梓生律師擔任講座。

第一場研討會由徐遵慈主任介紹全球供應鏈重組與「友岸外包」趨勢、台商投資趨勢主要課題、經貿糾紛並提出若干策略上之建議，供台商企業之決策人士參考。第二場研討會主講人吳梓生律師則以其曾擔任多年國際律師及仲裁人的經驗，針對「認識經貿糾紛的類型、如何防止經貿糾紛、法律救濟途徑及如何解決糾紛」等三個課題進行介紹，並搭配近期國際經貿局勢及中美、東協國家政策，內容豐富多元可作為企業投資風險評估指標。

Risk Management and Dispute Resolution Mechanisms

On the morning of October 29, a seminar titled “Risk Management and Dispute Resolution Mechanisms: From the Perspective of Taiwanese Businesses” was held. This event was a collaborative effort between the CAA Taichung Office, the Taichung Bar Association (TCBA), and the Asia Taiwanese Chambers of Commerce (ASTCC). The seminar was designed to equipt TCBA and ASTCC members with the fundamentals of arbitration and to provide them with essential legal resources relevant to their business operations.

The seminar featured two distinguished speakers:

• Global Supply Chain Reconstruction and Strategic Approaches: Kristy Hsu, the Director of the Taiwan ASEAN Studies Center (TASC) at the Chung-Hua Institution for Economic Research, led the first session. Hsu focused on the ongoing reconstruction of the global supply chain, she offered strategic insights into friend-shoring, overseas investment, and handling trade disputes. Her guidance was particularly relevant for businesses navigating the complexities of the current global economic landscape.

• Preventing and Resolving Trade Disputes: Tzu-Sheng Wu, an Associate Partner at Justus Law Office with extensive experience in international litigation and arbitration, presented the second session. He discussed various types of trade disputes, strategies for prevention, and available legal remedies. Drawing on examples from recent global economic situations and trade policies of major players like the U.S., China, and ASEAN countries, Wu provided practical advice that could be instrumental for Taiwanese companies considering international investments.

This seminar played a crucial role in equipping Taiwanese businesses with the knowledge and tools necessary for effective risk management and dispute resolution in the international arena. The insights shared by the speakers were tailored to help these businesses navigate the increasingly complex and interconnected global market, emphasizing the importance of understanding arbitration and legal strategies in international trade.
