金門縣不動產開發商同業公會王名譽理事長來訪Honorary Chairman Li-Pang Wang of the Real Estate Development Association of Kinmen Tours CAA


金門縣不動產開發商同業公會名譽理事長王立邦於本(112)年7月18日率同該公會副理事長李國民、秘書長張峰發以及齊鈺開發股份有限公司董事長洪展偉至本會拜訪吳永乾理事長,本會李天任秘書長以及仲裁人謝定亞教授偕同接待。

王理事長表示先前在其他場合聽過本會介紹仲裁後,相當認同此紛爭解決機制兼具迅速且經濟的優點,並表示金門的民事訴訟案件從遞交起訴狀到第一次開庭往往耗時長達半年;此外,法院一個審級平均要超過一年才結案,案件若走到三級三審,對於紛爭解決而言缺乏效率。王理事長並分享,建商面臨的驗屋糾紛相當多,目前他所簽定的相關制式合約均已納入仲裁條款,並提供其他會員參考採用。謝教授則就其參與工程爭議的經驗分享,本土企業常因企業文化及作業流程與外國企業間之差異甚大,因而未能落實合約之標準作業程序,導致工程驗收時發生糾紛,也都要透過仲裁解決。

齊鈺開發洪董事長也提出許多關於採用仲裁解決紛爭的疑問,吳理事長以其擔任仲裁工作的豐富經驗一一解答了有關先調後仲、標的金額的認定及仲裁費用計算、撤銷仲裁判斷等實務運作方式。

They were warmly received by CAA Chairman Dr. Joe Y. C. Wu, Secretary-General Dr. Tien-Ren Lee, and arbitrator Prof. Ting-Ya Hsieh.

Previously briefed on CAA's arbitration mechanism, Chairman Wang expressed agreement that arbitration often proves to be more efficient and economical than litigation. He cited examples from Kinmen, where civil lawsuits frequently require over half a year from the filing of the claim to the first hearing, and more than a year for the court to deliver its ruling. If the case moves to the High Court or Supreme Court, resolution can take even longer. In response to the frequent disputes arising from building inspections between constructors and buyers, Chairman Wang has begun including arbitration clauses in his business contracts, recommending this practice to other Association members. Prof. Hsieh added insight from his own experience, highlighting that Taiwanese construction companies often engage in arbitration with foreign buyers, as they commonly fail inspections due to unfamiliarity with the strict adherence to Standard Operating Procedures (SOPs) in construction plans.

Chan-Wei Hung, Chairman of Chi-Yu Corp., further engaged Chairman Wu in a series of questions related to the adoption of arbitration, discussing topics such as med-arb, the valuation of claims, arbitration fees, and the criteria for revoking an arbitral award. The meeting reflects an ongoing collaboration and mutual interest in enhancing the efficiency and fairness of dispute resolution in the construction and real estate sectors.
