仲裁人倫理研討會Workshop on Arbitrator Ethics


英國最高法院去年底發布Halliburton Company v Chubb Bermuda Insurance Ltd之判決,強調仲裁人獨立性是法律規定之義務。仲裁人是否有情事可能導致對其獨立產生合理懷疑,應以仲裁之私法特性,由無所偏倚的第三人角度,客觀檢視,進而論述仲裁人告知義務。

中華民國仲裁協會為強化仲裁人之公正性與獨立性,自106年5月起請仲裁人填具「仲裁人聲明書」時,參考最新版本的「國際律師協會國際仲裁利益衝突指引」,從第三人角度思考有無就任何可能導致當事人合理懷疑的情事而須揭露。

爰此,本會將於本(110)年6月1日下午舉辦「仲裁人倫理研討會」。特邀請本會仲裁人倫理委員會主委、前監察委員古登美教授為主持人;高蓋茨法律事務所黃璽麟律師與眾達國際法律事務所趙梅君律師,分別以「Halliburton Company v Chubb Bermuda Insurance Ltd判決對仲裁人揭露義務的意涵探討」與本會「仲裁人聲明書『告知』義務條款評析」提出報告;世新大學林輝煌教授、眾才法律事務所陳希佳律師、常在國際法律事務所朱麗容律師與國立政治大學法學院姜世明教授與談,歡迎仲裁人及有志探討該一主題各界先進踴躍報名參加(活動訊息請點此)。
 
The UK Supreme Court's decision in Halliburton Company v Chubb Bermuda Insurance Ltd. (“Halliburton decision”), rendered at the end of 2020, involves few questions related to the independence and impartiality of arbitrators. The decision reiterated that the question of whether circumstances may incur reasonable doubts as to the arbitrator's independence and impartiality should be examined objectively from the perspective of an informed and impartial third party. The court should also take into account the nature of arbitration as a private dispute resolution method. The court also addressed the arbitrator's duty to disclose and its implications on arbitrator's impartiality.

In order to enhance the impartiality and independence of arbitrators, CAA incorporated the latest version of the IBA Guidelines on Conflicts of Interest in International Arbitration into its standard Arbitrator's Statement in May 2017. The arbitrators are required to take into account the IBA Guidelines as well as Taiwan's Arbitration Law when considering any matters that might give rise to reasonable doubt to their impartiality.

To further illustrate the importance of the issues and provide concrete examples, CAA will host a workshop on arbitrator ethics on June 1, 2021. The seminar will be moderated by Professor Deng-Mei Ku, former member of Taiwan Control Yuan and President of the CAA Ethics Committee. Mr. Shilin Huang of K&L Gates and Ms. Marianne Chao of Jones Day will also present on “the implications of the Halliburton decision on the arbitrator's duty to disclose” and “critique of the ‘disclosure clause' in the CAA arbitrator statement”.
 
Other distinguished penalists include: Professor Huei-Huang Lin of Shih Hsin University, Ms. Helena Chen of iADR, Ms. Lilian Chu of Tsar & Tsai Law Firm, and Professor Shyh-Ming Chiang of the National Chengchi University College of Law.
