對亞洲臺商推廣仲裁合作會議Strategic Cooperation Meeting Between CAA and ASTCC


本會李天任秘書長於本(112)年7月19日率同莊開旭顧問及推廣組侯惇議組長,與亞洲臺灣商會聯合總會(下稱「亞總」)候任總會長許玉林、鄭文忠秘書長及安聯國際法律事務所吳俊儒主持律師(在臺灣及越南執業)於亞總第三十屆第三次理監事聯席會議前針對如何向亞洲臺商推廣仲裁進行意見交流。

接續前次許候任總會長於本年4月的到會參訪,本次雙方針對向臺商推廣仲裁時可能面臨的挑戰以及建議採取的策略有更進一步具體討論。許候任總會長表示,多數亞洲臺商並不清楚仲裁機制,建議本會可把握亞總及各國臺商總會召開會員大會時介紹仲裁,後續再辦其他推廣活動時,更能吸引潛在需要仲裁服務的臺商參與,更具推廣成效。吳律師(其夫人為越籍律師)以其在越南執業的經驗分享,目前在越臺商無論是臺商間或與當地廠商間的糾紛若採仲裁的方式解決,由於涉及財產執行及契約語言以越南文為主,仍以在越仲裁較多。若要推廣在臺仲裁,則需要在仲裁服務以及仲裁判斷的跨國執行方面展現在臺仲裁的優勢。

本會李秘書長感謝亞總方面提供非常務實的推廣建議,也承諾本會將積極整合現有資源、完備各地仲裁法制基礎研究,讓亞洲臺商能安心使用本會之仲裁服務。

On July 19, 2023, a strategic cooperation meeting took place between key members of the CAA and the incoming President of the Asia Taiwanese Chambers of Commerce (ASTCC), Mr. Yu-Lin Hsu, immediately prior to ASTCC's 30th Third Joint Meeting of Supervisors and Directors. On behalf of CAA, Dr. Tien-Ren Lee, Secretary-General; Cash Chuang, Advisor; and Kevin Hou, Manager for Business Development met with ASTCC's Secretary-General Wen-Chung Cheng and Mr. Gary Wu, Managing Partner of Anlian Law (who practices law in both Taiwan and Vietnam), were also present.

This meeting, a follow-up to incoming President Hsu's April visit, allowed both parties to delve into specific strategies to promote arbitration among overseas Taiwanese businesses and identify challenges that need to be addressed. President Hsu reiterated that a lack of awareness about arbitration among many business owners necessitates a more active role from CAA. He suggested CAA's participation in ASTCC's and other Taiwanese business associations' general meetings in order to introduce arbitration to their members. Such efforts could spark interest in and active participation with CAA's arbitration services.

Mr. Wu of Anlian Law noted the preference among Taiwanese businesses in Vietnam for domestic arbitration, due largely to the use of Vietnamese in business documents and the location of assets within Vietnam. In order to encourage Taiwanese business owners to settle disputes in Taiwan, CAA should emphasize the benefits of doing so and alleviate concerns related to the recognition and enforcement of Taiwanese arbitral awards.

Secretary-General Dr. Lee, speaking for CAA, expressed gratitude for the sharp and practical suggestions from ASTCC. He committed CAA to a thorough examination of arbitration practices across different countries, aiming to enhance CAA's services for Taiwanese businesses operating abroad. This meeting marked a significant step towards fostering closer ties and cooperation between CAA and ASTCC in the interest of promoting efficient dispute resolution.
